CE Marking Association Annual Seminar 2021

The CE Marking Association’s Annual Seminar was held yesterday (3rd November) with addresses from Oxford Innovations (Formally EGS) and Manufacturing Technology Centre (MTC) as well our guests from the UK Government Department of Business, Energy and Industrial Strategy (BEIS) and a number of our own in-house speakers.

Following the virtual seminar we hosted last year, it was fantastic to be able to meet the majority of our delegates face-to-face however at the same time, we were happy to be able to offer remote access to those unable to travel.

Following the unavoidable last minute cancellation of BEIS in 2019 due to the General Election and Purdah rules, I am glad we were able to offer them a platform to detail how product compliance will shape up as we move forward. They have asked us to thank the seminar for the challenging questions and feedback which they will take back.

Extension to UKCA Mark Deadline

The UK Government yesterday (24th August) announced an extension to the derogation to allow CE marked products to be placed on the UK market until 31st December 2022.

As such products placed on the UK market (with the exception of Northern Ireland) after 1st January 2023 must carry the UKCA mark.

The CE Marking Association will continue to monitor product compliance legislation, particularly with respect to Brexit and will further update our clients as more information is released.

Re-Opening of the CE Marking Association Offices

In line with the UK Government’s decision to move to Step 4 of the Covid Roadmap, the CE Marking Association will be fully opening our offices as of Monday 2nd August. 

As a result, we will be welcoming visitors back to our office for:

  • Training Workshops
  • Members’ face-to-face consultancy
  • EMC witnessed testing for more than one client

In order to maintain the safety of both our staff and clients, we continue to operate mitigating measures as follows:

Our staff will wear face coverings whilst engaged with clients with the exception of staff delivering training workshops. Clients will be invited to wear face coverings although there will be no expectation for them to do so.

All visitors to site will be asked to fill in a Covid questionnaire and will be expected to inform us of any positive test within 14 days of visiting the site. This information will be treated in strict confidence.

Training workshops will, from 2nd August be conducted as ‘hybrid’ events with delegates invited to either attend site or to access the workshop through Microsoft Teams. Our events are currently limited to 10 delegates on site in order to enable each delegate their own desk. We will be providing buffet lunches, however delegates will be more than welcome to bring their own refreshments if they so wish.

Hand gel, face coverings and anti-bacterial wipes will be made available to all visitors.

EU MARKET SURVEILLANCE REGULATIONS ARE HERE

On the 16th July, EU Regulation (EU) 2019/1020 came into force. This Regulation imposes additional market surveillance requirements on CE Marked products entering the EU from a third country such as the UK.

The Regulation requires that prior to entering the EU, a third country Manufacturer must identify an ‘Economic Operator’ on the product, packaging or accompanying paperwork. An Economic Operator can be:

  • Another Manufacturer
  • An Importer
  • An Authorised Representative
  • A Fulfillment Centre

 

The regulation does not require third country manufacturers to appoint an EU Authorised Representative; this is reserved as an option. As a result of the UK leaving the European Union; anybody who brings products into the EU from the UK becomes an Importer and as such the obligations of the Regulation can be met simply by identifying that person or organisation.

The Regulation is intended to facilitate market surveillance in the EU to the extent that it will be easier to identify non-compliant products prior to entering the EU; as such as a third country (inc. UK) Manufacturer, if you do not follow this Regulation, it is highly likely that your goods will be rejected at the EU border.

To note, as under the terms of the EU Withdrawal Agreement, Northern Ireland although part of the UK, remains part of the Single Market and as such, the Regulation does not apply to good originating from there.

COVID-19 Statement

Following the increase in prevalence in the COVID-19 virus and the UK’s nationwide move into Tier 4 measures, the CE Marking Association has updated its Risk Assessment to reflect the current measures.

Unfortunately, we have had to make the difficult decision to cease inviting visitors on site unless delivering or collecting products. This mainly affects our EMC assessments  which we have recently been able to invite clients to witness. All witnessed EMC assessments will now take place (if requested) remotely via Microsoft Teams. I hope you understand that we have taken these measures in the interests of the safety of both our clients and our staff. We currently don’t have any on-site work booked before the first review period in the middle of February. and therefore we will further communicate when we have received the Government’s advice at this point.
