The UK has now left the European Union but more importantly for the purposes of product compliance, the Single Market
The UK Government has issued guidance to UK Manufacturers regarding the placing of products on the UK market as well as placing products on the EU market. The Government has issued similar advice for Medical Devices and for Construction Products.
With regards to the UK Market, the majority of CE Marking legislation was written into UK law and the legislation that was not, was transposed into UK law as the UK left the EU. At the moment, only minor amendments have been made to that legislation to allow it to work in the United Kingdom.
At present, a derogation in UK law allows CE marked products to be placed on the market in Great Britain indefinitely. This option is offered in addition to the 'UK' mark.
Special arrangements apply in Northern Ireland in order to maintain the Good Friday Agreement. Northern Ireland remains within the European Market (subject to periodic ratification by the Northern Ireland Assembly). As such the default position is that goods entering Northern Ireland must be CE marked, however provision is made by way of the Northern Ireland mark ('UKNI') for goods meeting UK but not EU legislation to also be placed on the Northern Ireland market.
