The Radio Equipment Directive (RED) (2014/53/EU) superseded the old R&TTE (Radio Equipment and Telecommunications Terminal Equipment and the Mutual Recognition of their Conformity) Directive (1999/5/EC) on the 13th June 2016. The original Directive, first came into force on the 7th April 2000, but as of the 13th June 2016, any new Declarations must be made out to the new Directive (2014/53/EU).
The Radio Equipment Directive applies to radio equipment defined as:
"an electrical or electronic product, which intentionally emits and/or receives radio waves for the purpose of radio communication and/or radiodetermination, or an electrical or electronic product which must be completed with an accessory, such as antenna, so as to intentionally emit and/or receive radio waves for the purpose of radio communication and/or radiodetermination." The Directive goes on to clarify that the radio wave covered by the Directive are where the frequencies are lower than 3 000 GHz.
The old R&TTE Directive also applied to 'telecommunications terminal equipment', which has now been taken out of scope and will be covered by the Low Voltage and EMC Directives. (Telecommunications terminal equipment was defined under 1999/5/EC as a product enabling communication or a relevant component thereof which is intended to be connected directly or indirectly by any means whatsoever to interfaces of public telecommunications networks (that is to say, telecommunications networks used wholly or partly for the provision of publicly available telecommunications services);
The scope of this Directive is subject to some exemptions:
1. Radio equipment used by radio amateurs (including radio kits for assembly, radio equipment that has been modified and equipment for experiment and scientific purposes), unless made available on the market.
2. Marine equipment falling within the scope of 96/98/EC
3. Airborne products, parts and appliances falling within the scope of Article 3 of Regulation (EC) No 216/2008
4. Custom-built evaluation kits destined for professionals to be used solely at research and development facilities for such purposes.
